1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the Zukani TV mobile application and website (together, the "Service"), operated by Ashu Ventures LLC, a Texas limited liability company ("Zukani," "we," "us," or "our"). By creating an account, downloading the app, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Description of the Service
Zukani TV is a mobile and web streaming platform for serialized drama content, primarily from African and African-diaspora creators. Most series are organized into episodes. Some episodes are free to watch; others require "Coins," an in-app virtual currency, to unlock.
3. Eligibility and Your Account
You must be at least 13 years old to create an account. If you are under the age of majority in your jurisdiction, you may only use the Service with the involvement of a parent or guardian. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at the contact details below if you suspect unauthorized use of your account.
4. Coins and Episode Unlocks
Coins are a virtual, in-app item purchased in packs through the Apple App Store or Google Play, or earned through free in-app activities such as daily check-ins, watching rewarded ads, or referrals.
- No cash value. Coins are not money, a deposit, or property. Coins have no value outside the Service, cannot be redeemed for cash, transferred between accounts, or resold.
- Unlocks are a 30-day access pass, not a permanent purchase. Spending Coins to unlock an Episode grants playback access to that Episode for 30 days from the moment of unlock. After that window, the Episode locks again, and unlocking it a second time costs Coins again.
- All Coin purchases and spends are final. Except where required by applicable law or by the policies of the Apple App Store or Google Play, Coins are non-refundable once credited to your account, and spent Coins are non-refundable once an Episode is unlocked.
- Pricing may change. We may adjust Coin pack pricing, the free Coin amounts offered for in-app activities, or the Coin price of any Episode (set by the Episode's creator) at any time.
- Purchases made through the Apple App Store or Google Play are also subject to those platforms' own terms and payment policies, including their respective refund policies.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms;
- Circumvent, disable, or interfere with Coin, playback, or content-access controls, including screen-recording or redistributing episode video outside the app;
- Use bots, scrapers, or automated means to access the Service or manipulate Coin balances;
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
- Upload, post, or transmit any content through the Service that is unlawful, infringing, harassing, or otherwise objectionable;
- Attempt to gain unauthorized access to any part of the Service, other accounts, or connected systems.
6. Content and Intellectual Property
Series and Episodes available on the Service are created and owned by independent creators who license Zukani the right to host and stream their work (see our separate Creator Agreement for the terms creators operate under). Zukani and its licensors retain all rights, title, and interest in the Service itself, including its design, branding, and software.
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable license to access and view content on the Service for your personal, non-commercial entertainment only. You may not copy, download, redistribute, publicly perform, or create derivative works from any content on the Service except as the Service's own functionality expressly permits.
If you believe content on the Service infringes your copyright, contact us using the details in Section 14 with enough information for us to identify the content and your claim.
7. Reporting Content
If you encounter content that violates these Terms or applicable law, you can report it directly from within the app. We review reports and may remove content or restrict accounts at our discretion.
8. Third-Party Services
The Service relies on third-party infrastructure, including Apple App Store and Google Play for purchases and app distribution, and Cloudflare for video delivery. Your use of those third-party services is subject to their own terms and privacy policies, which we do not control.
9. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service, with or without notice, if we believe you have violated these Terms, engaged in fraudulent or abusive behavior, or for any other reason at our discretion. Coins are forfeited without compensation if your account is terminated for a violation of these Terms.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ZUKANI AND ASHU VENTURES LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Collin County, Texas, except that either party may bring an individual claim in small claims court where eligible.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email. Continuing to use the Service after changes take effect means you accept the updated Terms.
